1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to Camperista.ro ("we," "us," "our," or "Camperista"). These Terms of

Service ("Terms," "Agreement," or "TOS") constitute a legally binding agreement

between you ("User," "Customer," "you," or "your") and Camperista.ro regarding

your access to and use of our website, products, and services.

By accessing our website at https://www.camperista.ro (the "Site"), creating an

account, placing an order, or using any of our services, you acknowledge that

you have read, understood, and agree to be bound by these Terms in their

entirety. If you do not agree with any part of these Terms, you must

immediately discontinue use of our Site and services.

We reserve the right to update, modify, or replace these Terms at any time at

our sole discretion. Changes will be effective immediately upon posting to the

Site. Your continued use of the Site after any changes indicates your

acceptance of the revised Terms.

Nothing in these Terms limits or excludes any mandatory statutory rights you

have as a consumer under Romanian law or EU law.

2. DEFINITIONS

2.1 "Products" refers to all physical goods offered for sale on Camperista.ro,

including but not limited to 3D-printed camper accessories, vanlife

equipment, air deflectors, water funnels, and related items.

2.2 "Services" refers to all non-physical offerings, including website access,

customer support, order processing, and related activities.

2.3 "Order" means a request to purchase Products through our Site.

2.4 "Customer" or "User" refers to any individual or entity who accesses the

Site, creates an account, or purchases Products.

2.5 "EU Consumer" refers to any natural person acting for purposes outside

their trade, business, craft, or profession, resident in the European

Union.

2.6 "Business Customer" refers to any entity or individual acting within their

trade, business, craft, or profession.

2.7 "Processing Time" refers to the time required to manufacture, prepare, and

package an Order before shipment.

2.8 "Delivery Time" refers to the time required for a carrier to transport an

Order from our facility to the delivery address.

2.9 "Shipping Policy" refers to the Camperista.ro Shipping & Returns Policy

published at https://www.camperista.ro/policies/shipping-policy, which

forms an integral part of these Terms.

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 ELIGIBILITY

By using our Site, you represent and warrant that:

(a) You are at least 18 years of age or the age of majority in your

jurisdiction;

(b) You have the legal capacity to enter into binding contracts;

(d) All information you provide is accurate, complete, and current.

3.2 ACCOUNT CREATION

To access certain features, you may need to create an account. When

registering, you agree to:

(a) Provide accurate, current, and complete information;

(b) Maintain and promptly update your account information;

(d) Accept responsibility for all activities occurring under your account;

(e) Notify us immediately of any unauthorized access or security breach.

3.3 ACCOUNT SECURITY

We reserve the right to:

(a) Refuse service, terminate accounts, or cancel orders at our discretion;

4. PRODUCTS AND SERVICES

4.1 PRODUCT DESCRIPTIONS

We make every effort to display our Products as accurately as possible.

However:

(a) Colors may vary depending on monitor settings and lighting conditions;

(b) Dimensions may have slight variations due to the 3D printing process

(typically ±0.5mm tolerance);

(d) Minor cosmetic imperfections inherent to 3D printing do not constitute

defects.

4.2 3D PRINTED PRODUCTS SPECIFICATIONS

Our Products are manufactured using FDM (Fused Deposition Modeling) 3D

printing technology. Customers acknowledge that:

(a) Layer lines are a normal characteristic of 3D printed items;

(b) Slight variations in texture and finish may occur between batches;

ABS filaments;

(d) Material specifications are clearly stated in each product listing.

4.3 PRODUCT AVAILABILITY

All Products are subject to availability. We reserve the right to:

(a) Discontinue any Product without prior notice;

(b) Limit quantities per order or per customer;

4.4 CUSTOM ORDERS

For custom or personalized orders:

(a) Specifications must be provided in writing;

(b) Additional processing time may be required;

accordance with art. 16 of OUG 34/2014, unless defective;

(d) Prepayment is required before production begins.

5. PRICING AND PAYMENT TERMS

5.1 PRICING

(a) All prices are listed in Euro (EUR) unless otherwise specified;

(b) Prices do not include shipping costs, which are calculated at checkout;

(d) We reserve the right to change prices without prior notice;

(e) Orders are charged at prices in effect at the time of order placement.

5.2 PAYMENT METHODS

We accept the following payment methods:

(a) Credit/Debit cards (Visa, MasterCard, American Express);

(b) Shop Pay;

(d) Google Pay (where available);

(e) Bank transfer (for Business Customers only).

5.3 PAYMENT PROCESSING

(a) Payment is charged at the time of order placement;

(b) All payments are processed through secure third-party payment

processors;

(d) Orders will not be processed until payment is confirmed.

5.4 CURRENCY CONVERSION

For international customers:

(a) Your bank may charge currency conversion fees;

(b) Exchange rates are determined by your payment provider;

5.5 INVOICING

(a) Electronic invoices are sent to the email address provided at checkout;

(b) Business Customers may request VAT invoices;

6. SHIPPING AND DELIVERY

6.1 SHIPPING POLICY REFERENCE

Detailed shipping conditions, carrier information, delivery procedures,

and the procedure for visibly damaged packages are described in our

Shipping & Returns Policy. The Shipping Policy forms an integral part of

these Terms. In case of conflict between this Section 6 and the Shipping

Policy, the Shipping Policy prevails for shipping-related matters.

6.2 SHIPPING DESTINATIONS

We ship to most countries in the European Union and to the United Kingdom.

Shipping to other destinations may be available on request. Restrictions

may apply due to:

(a) Customs regulations;

(b) Carrier limitations;

6.3 PROCESSING TIME

(a) Standard processing time is 1-3 business days;

(b) Custom orders may require 3-7 business days processing time;

(d) During peak seasons (November-January), processing times may be

extended.

6.4 SHIPPING METHODS AND DELIVERY TIME

We use a two-leg fulfillment model: Sameday Courier transports orders from

Romania to our EU hub in Hungary, and PostNL distributes packages to the

final delivery address.

STANDARD SHIPPING:

- Romania: 1-3 business days

- EU Countries: 5-14 business days

- Rest of Europe: 5-20 business days

- International: 7-28 business days

Delivery times are estimates from the moment the order leaves our

facility and are not guaranteed.

6.5 SHIPPING COSTS

(a) Shipping costs are calculated based on destination, weight, and

dimensions;

(b) Free shipping is currently offered on orders above 50 EUR. This

threshold is promotional and may be modified at any time; the value

in effect is the one displayed at checkout on the day of the order;

(d) Import duties and taxes outside the EU are the responsibility of the

Customer.

6.6 ORDER TRACKING

(a) Tracking numbers are provided via email once orders ship;

(b) Tracking information may take 24-48 hours to become active;

6.7 DELIVERY ISSUES

(a) Customers must verify shipping address accuracy before placing orders;

(b) We are not responsible for delays due to incorrect addresses;

addresses may incur a re-shipping fee;

(d) Lost packages must be reported within 30 days of shipment.

6.8 CUSTOMS AND IMPORT DUTIES

(a) Orders shipped outside the EU may be subject to customs inspection;

(b) Import duties, taxes, and customs fees are the Customer's

responsibility;

(d) We are not responsible for customs delays or seizures.

7. RETURNS, REFUNDS, AND EXCHANGES

================================================================================

7.1 RETURN POLICY OVERVIEW

We want you to be satisfied with your purchase. Detailed return procedures

are described in our Shipping & Returns Policy. This Section 7 sets out

the main contractual conditions.

7.2 RIGHT OF WITHDRAWAL (EU CONSUMERS)

In accordance with OUG 34/2014 (Romanian implementation of EU Directive

2011/83/EU), if you are an EU Consumer, you have the right to withdraw

from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire after 14 days from the day:

(a) You or a third party acquires physical possession of the goods; or

(b) In the case of multiple goods ordered in one order, the day you

acquire physical possession of the last good.

To exercise the right of withdrawal, send an unequivocal statement of

your decision to contact.camperista@gmail.com before the 14-day period

expires.

7.3 CONDITIONS FOR RETURNS

To be eligible for a return:

(a) The item must be unused and in the same condition received;

(b) The item must be in original packaging;

(d) Return requests must be made within the applicable timeframe.

7.4 NON-RETURNABLE ITEMS

In accordance with art. 16 of OUG 34/2014, the following items are

excluded from the 14-day right of withdrawal:

(a) Custom or personalized products (unless defective);

(b) Items damaged due to misuse, negligence, or accidents;

(d) Products damaged by exposure to extreme temperatures, chemicals, or

UV radiation;

(e) Gift cards or digital products.

7.5 RETURN PROCESS

To initiate a return:

(a) Contact us at contact.camperista@gmail.com with your order number;

(b) Wait for return authorization and instructions;

(d) Ship to the provided return address;

(e) Provide tracking information.

7.6 REFUND PROCESSING

(a) Refunds are processed within 14 calendar days of receiving and

inspecting the returned items;

(b) Refunds are issued to the original payment method;

together with the cost of the cheapest standard delivery option

originally offered, in accordance with art. 13(2) of OUG 34/2014.

Any additional cost chosen by the Customer (express shipping,

insurance, etc.) is not refunded;

(d) Return shipping costs for a 14-day voluntary withdrawal are the

Customer's responsibility. Return shipping for defective, damaged,

or wrongly shipped items is covered by Camperista.

7.7 PACKAGES VISIBLY DAMAGED IN TRANSIT

(a) If your package arrives with visible external damage (crushed box,

torn packaging, opened seal, broken product visible without

opening), you must refuse the parcel at delivery or sign with

reservations and notify us within 48 hours of delivery;

(b) Photographic and/or video evidence of the external damage and of the

product condition at unboxing is required;

allow us to file a timely carrier claim. It does not limit your

legal warranty rights under Section 8;

(d) For verified transit damage we will, at your option, send a

replacement (subject to stock availability) or issue a full refund.

Return shipping is covered by Camperista.

7.8 DEFECTIVE ITEMS DISCOVERED AFTER UNPACKING

(a) If a manufacturing defect is discovered after unpacking, report it as

soon as reasonably possible at contact.camperista@gmail.com with a

description and photographic/video evidence;

(b) Defects of conformity are covered by the 2-year legal warranty set

out in Section 8;

Customer's preference where the law allows, a free replacement, a

full refund, or a partial refund / discount. Return shipping is

covered by Camperista.

7.9 WRONG ITEMS RECEIVED

If you receive an incorrect item:

(a) Contact us within 48 hours of receipt at contact.camperista@gmail.com;

(b) We will arrange return shipping at our expense;

8. LEGAL WARRANTY OF CONFORMITY (2 YEARS)

================================================================================

8.1 SCOPE

Independently of the 14-day right of withdrawal set out in Section 7.2,

EU Consumers benefit from the legal warranty of conformity of 2 years

from delivery, in accordance with Law 449/2003 and OUG 140/2021 (Romanian

implementation of EU Directive 2019/771).

8.2 REMEDIES

If, during the 2-year period, the product is not in conformity with the

contract, you have the right to:

(a) Repair of the product;

(b) Replacement of the product;

(d) Termination of the contract and a full refund,

under the conditions and in the order set out by applicable Romanian law.

8.3 COST OF WARRANTY CLAIMS

For verified non-conformity claims, the cost of returning the product is

covered by Camperista.

8.4 LIMITATIONS

The 2-year legal warranty does not cover damage caused by:

(a) Misuse, abuse, or installation contrary to our instructions;

(b) Exposure to temperatures above the limits set out in Section 11.2

(60°C / 140°F for PLA, 70°C / 160°F for PETG);

(d) Normal wear and UV degradation after prolonged outdoor exposure;

(e) Modifications or repairs performed by the Customer or a third party

without our prior written authorization.

8.5 HOW TO CLAIM

To claim under the legal warranty, contact contact.camperista@gmail.com

with your order number, a description of the issue, and photographic

or video evidence. We aim to respond within 2 business days.

9. INTELLECTUAL PROPERTY RIGHTS

================================================================================

9.1 OWNERSHIP

(a) All content on the Site, including text, graphics, logos, images,

product designs, and software, is the property of Camperista or its

licensors;

(b) Our Products are protected by design rights, copyright, and other

intellectual property laws;

9.2 LICENSE TO USE

Subject to these Terms, we grant you a limited, non-exclusive,

non-transferable license to:

(a) Access and use the Site for personal, non-commercial purposes;

(b) Purchase and use Products for their intended purpose;

9.3 PROHIBITED USE

You may not:

(a) Copy, reproduce, distribute, or publicly display any Site content

without permission;

(b) Modify, translate, or create derivative works from our Products or

designs;

(d) Use our trademarks without written consent;

(e) Sell, license, or commercially exploit our designs or Products.

9.4 COPYRIGHT INFRINGEMENT

If you believe your intellectual property rights have been infringed:

(a) Submit a written notice to contact.camperista@gmail.com;

(b) Include identification of the copyrighted work claimed infringed;

(d) Provide your contact information and a statement of good faith belief.

9.5 USER-GENERATED CONTENT

If you submit content to us (reviews, photos, suggestions):

(a) You grant us a perpetual, worldwide, royalty-free license to use such

content;

(b) You represent that you own or have rights to the content submitted;

discretion.

10. USER CONDUCT AND PROHIBITED ACTIVITIES

10.1 ACCEPTABLE USE

You agree to use our Site and Products only for lawful purposes and in

accordance with these Terms.

10.2 PROHIBITED CONDUCT

You agree not to:

(a) Use the Site in any way that violates applicable laws or regulations;

(b) Engage in fraudulent activities or submit false information;

(d) Interfere with other users' access or use of the Site;

(e) Use automated systems (bots, scrapers) to access the Site;

(f) Upload viruses, malware, or malicious code;

(g) Harass, threaten, or intimidate our staff or other users;

(h) Use Products for illegal or dangerous purposes;

(i) Resell Products without written authorization.

10.3 CONSEQUENCES OF VIOLATIONS

Violation of these rules may result in:

(a) Immediate termination of your account;

(b) Refusal to process current or future orders;

(d) Reporting to law enforcement authorities.

11. PRODUCT SAFETY AND DISCLAIMER OF WARRANTIES

11.1 PRODUCT INTENDED USE

Our Products are designed for specific applications in camper vans,

motorhomes, and recreational vehicles. Users must:

(a) Follow all installation instructions provided;

(b) Use Products only for their intended purpose;

(d) Regularly inspect Products for wear or damage.

11.2 SAFETY WARNINGS

(a) Some Products may have sharp edges - handle with care;

(b) Products are not toys and should be kept away from children;

to temperatures exceeding 60°C (140°F) for PLA, 70°C (160°F) for

PETG;

(d) Products exposed to prolonged UV light may degrade over time;

(e) Chemical exposure (solvents, fuels, oils) may damage Products.

11.3 DISCLAIMER OF WARRANTIES

Without prejudice to the legal warranty of conformity set out in

Section 8 and any other mandatory consumer rights, all Products and

Services are otherwise provided "AS IS" AND "AS AVAILABLE" WITHOUT

ADDITIONAL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING

BUT NOT LIMITED TO:

(a) IMPLIED WARRANTIES OF MERCHANTABILITY;

(b) FITNESS FOR A PARTICULAR PURPOSE;

(d) ACCURACY, COMPLETENESS, OR RELIABILITY OF SITE CONTENT.

11.4 NO GUARANTEE

We do not guarantee that:

(a) The Site will be uninterrupted, timely, secure, or error-free;

(b) The results obtained from using the Site will be accurate or

reliable;

11.5 LIMITATION ON IMPLIED WARRANTIES

Nothing in this Section 11 affects mandatory consumer rights that

cannot be limited or excluded under Romanian or EU law.

12. LIMITATION OF LIABILITY

12.1 EXCLUSION OF DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT PREJUDICE

TO MANDATORY CONSUMER RIGHTS, IN NO EVENT SHALL CAMPERISTA, ITS

DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE

LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE

DAMAGES, INCLUDING WITHOUT LIMITATION:

(a) LOSS OF PROFITS;

(b) LOSS OF DATA;

(d) LOSS OF GOODWILL;

(e) PERSONAL INJURY;

(f) PROPERTY DAMAGE;

(g) ANY OTHER INTANGIBLE LOSSES.

12.2 LIABILITY CAP

Subject to Section 12.3, our total liability to a Business Customer for

all claims arising from or relating to these Terms or the use of the

Site and Products shall not exceed the amount paid by the Business

Customer for the specific Product giving rise to the claim or one

hundred Euro (€100.00), whichever is greater. This cap does NOT apply

to EU Consumers, whose statutory remedies are not capped.

12.3 EXCEPTIONS

Nothing in these Terms shall limit or exclude our liability for:

(a) Death or personal injury caused by our negligence;

(b) Fraud or fraudulent misrepresentation;

(d) Any other liability that cannot be excluded under applicable law.

12.4 FORCE MAJEURE

We shall not be liable for any failure or delay in performing our

obligations where such failure or delay results from circumstances beyond

our reasonable control, including but not limited to:

(a) Acts of God, flood, drought, earthquake, or other natural disasters;

(b) Epidemic or pandemic;

(d) War, threat of war, armed conflict;

(e) Nuclear, chemical, or biological contamination;

(f) Any law or action taken by a government or public authority;

(g) Collapse of buildings, fire, explosion, or accident;

(h) Interruption or failure of utility service.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Camperista, its affiliates,

officers, directors, employees, agents, suppliers, and licensors from and

against any claims, liabilities, damages, losses, costs, and expenses

(including reasonable attorneys' fees) arising from or relating to:

(a) Your use of the Site or Products;

(b) Your violation of these Terms;

or privacy rights;

(d) Any damage caused by your improper use of Products;

(e) Any user content you submit to the Site.

This indemnification obligation shall survive termination of these Terms and

your use of the Site. This Section does not apply to EU Consumers to the

extent it would conflict with mandatory consumer protection law.
